Update on the Sherk appeal

Just an FYI, Sherk’s lawyer is currently on the floor at the CSAC attacking the legitimacy of their test results, specifically calling into question the chain of custody the tests go through.

In my opinion, Sherk’s best chance of winning came from the ‘tainted supplement’ angle. The fact that his lawyer is using the ‘CSAC sucks and fucked up’ argument doesn’t bode well for Sherk’s case.

    Yep. Sherk will be off for a year. His lawyer needs to realize this isn’t a Jury and the organization he is attacking in the one making the final decision.

    It seems he can’t substantite that he actually had tainted supps.

    On the other hand, CSAC gets to make the call whether CSAC did anything wrong? My spidey sense is telling me CSAC will probably make the call that CSAC did everything just right. This will force Sherk to appeal, I assume he can appeal to some higher authority?

  • Nope CSAC is top body. This isn’t the Olympics or anything, there’s not 15 levels of government controlling this.

    Stating your supplements are tainted does not win this case. If you can find a tainted supplement, they will still suspend you based on the fact that they tell fighters to test their supplements before taking them. Almost every single governing body to sports who test athletes stated this along with the World Doping Agency.

    He can only get out of it by proving a product on the safe list actually has traces of nandrolone. He’s screwed. Thanks for wasting our time Sean Sherk.

  • I would rather have Sherk vs Penn as a fight. But if it’s a choice between no title shots for another 3-4 months and Penn vs Stevenson for the belt (laaaaaame … jeez, wonder how that will turn out)

  • And Leland : Keizer has stated if it’s an ‘approved supplement’ and he can prove the batch was tainted, then he would be cleared. That’s NSAC talking, but I don’t see why that wouldn’t work for the CSAC too.

  • Besides, we’re talking more than just guilty / not guilty. Sherk’s best result walking out of here is to be guilty but have proof he didn’t knowingly take steroids. I’d be fucking blown away if he gets out of this not guilty.

    I’d rather that Sherk’s boring ass was stripped ASAP and that I wouldn’t have to spend another minute watching him take somebody down just so that he could lay on them for 5 minutes. Could the CSAC knock 3 months off his suspension if he spends the rest of his time training Muay Thai or something?

    I was curious because Sherk’s lawyer is using the same defense that Floyd Landis used in his tour de france doping case and come to find out it’s the same damned lawyer. The Muscle Shark is in trouble.
