Josh Thomson is a big fucking baby

Did you know that being called a homosexual is such an insult that you can sue someone for slander over it? Up until this point it’s mainly politicians and such who take matters to the court when a major newspaper tries to smear them by ‘outing’ them as gay. But now we’ve reached a new milestone in mixed martial arts history: when talking shit about a guy can get you slapped with court papers.

PDG: Last night during the broadcast on Yahoo sports, Frank Shamrock was commentating. When you entered the ring Frank said that you were “The first openly gay fighter in mixed martial arts.”

Josh: Yea I know I have been hearing about that. I think that my agent is in the process of hiring a lawyer to file a lawsuit against Frank for slander. We’ll see how that goes.

The reason what Shamrock did is considered slander is because it wasn’t obvious to the average person that this was a joke. That might seem like an unimportant distinction, but trust me it is. That’s why on this site I can call fighters fags and drunks and rapists and molesters and not get into trouble. My site is so obviously retarded that no one can potentially take me seriously. Free speech is designed to protect comedians, satirists, and even low-brow humorists like myself.

On the other hand, Frank Shamrock deadpanned the statement in such a way that he was trying to pass it off as real. As soon as you’re trying to deceive people into thinking something is true that isn’t, and that thing affects another person’s reputation or livelihood … bam! That’s slander for ya.

Anyways, perhaps if this had happened on NBC or something I’d be concerned. But honestly, only the hardcore MMA fans streamed the Strikeforce show off Yahoo Sports. And then only the most hardcore of the hardcore managed to watch long enough to hear Frank’s comment. So yeah, maybe a couple TUF Noobs think Josh is gay. At least they’ll remember who is is now.

**UPDATE** I originally used the term libel instead of slander in this article. Libel is written, slander is spoken. I hope no one is studying for the bar exam using the stuff I write on the blog or they might get that question wrong.

    I believe theres no such thing as bad press.. If your going to be ousted as gay– true or not– I say he should come to the ring in a pair of fishnets and feather boa. It would make news, and in a business like MMA being a good fighter is about 75% of what it takes, the other 25% is being marketable.

    Then after going out and destroying your oppenent he could say he’s not gay, but even if he was he’d be more manly than Frank Shamrock. That would be more of a slap to Frank than paying a few grand for slander.

    I agree with what your saying, but, just a heads up, ( I am not a lawyer) slander = verbal, libel = written.
    As a side note, keep up the good fuckin’ work fightlinker. Your rude, crude, motherfuckin’ nasty, throw in a little wittyness, maybe a tiny bit of intelligence, and that equals what I think will continue to be a growing fan base and readership.

    You immediately know when someone should shut the fuck up about defamation laws… that point is when they call verbal defamation “libel.” At that point, you should pretty much up the shut fuck.

    Libel = written defamation
    Slander = verbal defamation

    Commenting on the validity of lawsuits as if you’re some big expert because you have a blog where you insult people yet can’t grasp the difference = poor.

    I love that you used argumentum ad populum to defend his “mistake”, but believe me, he and the rest of the world will be better off getting the difference between libel and slander correct. Especially if they’re going to mock people for suing others while trying to educate his readership.

  • Last time i checked, two paragraphs about the most basic tenants of libel and slander != me pretending to be an expert. I read several articles on the subject, based my comments on those, and that’s that. The articles I read re politicians were suing for libel so I got mixed up with terminology. I’ll make sure to fire my editor and fact checker for this obvious mistake, plus I’m thinking of firing myself for pretending to be a lawyer or something.

    Xavier is right–it is alleged slander, not libel.
    And Josh’s case is going to be hard to prove, given the history between these two. Frank knows Thomson personally, and all he has to say is that he genuinely thought Thomson is gay (based on the Glamrock T-shirt or whatever other evidence Frank wants to claim). Plus, they are both public figures, so the legal standard for tortious slander is much higher. Josh is going to look like an ass litigating this.

    I don’t know, it’s hard for Shamrock to claim that since his statement is that Thomson is “openly gay.” Shamrock can’t claim that private knowledge of Thomson via friendship would make Thomson is openly gay since openly = public acknowledgement by Thomson.

    Even using the “best belief” defense won’t help Frankie too much because again, he was making a statement which literally says that Thomson was public and “out” as a homosexual. And as Fightlinker correctly pointed out, he can’t claim it was a joke because it wasn’t delivered as such.

    The fact that there’s previous bad blood between Thomson and Shamrock REALLY doesn’t help Shamrock either, since Thomson can prove what is usually the hardest part of defamation, maliciousness, quite easily.

    All that garbage said, I truly doubt Thomson would win… well, anything in the way of damages… considering that being a homosexual doesn’t itself carry much in the way of negative connotations in the eyes of your average court.
